Who can become a user?

Our services are available only to individuals (excluding minors) who can form legally binding contracts under applicable law

This is an agreement between GEMN Research & Development Private Limited, a company incorporated under the laws of India (“GEMN " or “We”, or “Us”, or “Our”), the owner and operator of the GEMN software, including (collectively, including all content provided by the GEMN App through the “GEMN Service", or the "Service"), and you (“User”, “you” or “You”), a user of the Service. BY USING THE SERVICE, YOU ACKNOWLEDGE AND AGREE TO THESE TERMS OF SERVICE, AND THE GEMN APP (the “App”) PRIVACY POLICY, WHICH IS CONTAINED HEREIN. If you choose to not agree with any of these terms, we cannot provide the Service. Further, our services are not available to temporarily or indefinitely suspended blood donors.in users.

1.1 You agree that Your use of the App implies Your consent to the collection, retention and use of Your personal information in accordance with the terms of this Privacy Policy ("Privacy Policy").

1.2 We hereby confirm that GEMN does not sell or rent the User information to any third party or use it for commercial gain. You hereby acknowledge that when You use the App, the App may collect Your device number and other personal information. We cannot ensure the security of Your data transmitted via the internet, telephone or any other networks.

1.3 Access to the contents available through the App is conditional upon Your approval of this Privacy Policy. You acknowledge that this Privacy Policy,forms Our agreement with You in relation to Your use of the App ("Agreement").

2.1 Traffic Data Collected

In order to provide the App, We automatically track and collect the following categories of information when You use the App:

(i) IP addresses;

(ii) Domain servers; and

(iii) Other information with respect to Your device, interaction of Your device with the App and applications (collectively "Traffic Data").

2.2 Personal Information Collected

In order to provide the App, We may require You to provide Us with certain information that personally identifies You ("Personal Information"). Personal Information includes the following categories of information:

(i) Contact data (such as Your e-mail address, phone number and any details of Your contacts); and

(ii) Demographic data (such as Your time zone, Your postal address and location details).

If You communicate with Us by, for example, e-mail or letter, any information provided in such communication may be collected by GEMN.

With respect to Personal Information (or any items listed therein):

1. shall not be false, inaccurate or misleading;

2. shall not be fraudulent;

3. shall not infringe any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy;

4. shall not violate any law, statute, ordinance or regulation (including without limitation those governing export control, consumer protection, unfair competition, anti discrimination or false advertising);

5. shall not be defamatory, unlawfully threatening or unlawfully harassing;

6. shall not contain any viruses, Trojan horses, worms, time bombs, cancel bots or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information;

7. shall not create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers.

2.3 Our App may transmit your Personal Information to our internal servers. This Personal Information is immediately deleted once you delete the App, except to the extent it is necessary to store the same under applicable laws. Further, we have implemented commercially reasonable physical, managerial, operational and technical security measures to protect the loss, misuse and alteration and to preserve the security of the Personal Information in our care. Finally, this information is used strictly in line with our business purposes and to provide you with useful features pertaining to the App.

2.4 Our App may contain links to third party websites or applications. You agree and understand that privacy policies of these websites are not under Our control. You understand that once You leave Our servers, use of any information You provide shall be governed by the privacy policy of the operator of the site used by you

3.1 We do not disclose Your Personal Information to any third parties or use it for commercial gain. We will not be held liable in the event our servers get hacked by unauthorised/unidentified sources leading in the loss of confidential data and Your personal information. However, these circumstances shall be duly notified and appropriate measures shall be taken to resolve the issue.

3.2 We reserve the right to disclose Personal Information if required to do so by law or if we believe that it is necessary to do so to protect and defend the rights, property, the App, or Our Users.

4.1 Except as otherwise provided in this Privacy Policy, We will keep Your Personal Information private and will not share it with third parties, unless We believe in good faith that disclosure of Your Personal Information or any other information We collect about You is necessary for Permitted Use or to:

4.1.1 Comply with a court order or other legal process;

4.1.2 Protect the Our rights, property or safety or those of or another party;

4.1.3 Enforce the Agreement, including Terms; or

4.1.4 Respond to claims that any posting or other content violates the rights of third - parties.

5.1 The security of Your Personal Information is important to Us. We follow generally accepted industry standards to protect the Personal Information submitted to Us, both during transmission and once We receive it.

5.2 Although We make best possible efforts to store Personal Information in a secure operating environment that is not open to the public, You should understand that there is no such thing as complete security, and We do not guarantee that there will be no unintended disclosures of Your Personal Information. If We become aware that Your Personal Information has been disclosed in a manner not in accordance with this Privacy Policy, We will use reasonable efforts to notify You of the nature and extent of such disclosure (to the extent We know that information) as soon as reasonably possible and as permitted by law.

6.1 We reserve the right, at any time, to add to, change, update, or modify this Privacy Policy so please review it frequently. If We do, then We will post these changes on this page. In all cases, use of information We collect is subject to the Privacy Policy in effect at the time such information is collected.

• You have a right to correct any errors in Your Personal Information available with Us. You may request Us in writing that We cease to use Your Personal Information.

• You have the right to a copy of information we hold about you.

• You have the right to be forgotten. You can request to be removed from the Service if you have yet to make a donation or provided any medical information.

8.1 We do not make any claims, promises or guarantees about the accuracy, completeness, or adequacy of the contents available through the App and expressly disclaims liability for errors and omissions in the contents available through the App.

8.2 No warranty of any kind, implied, expressed or statutory, including but not limited to the warranties of non-infringement of third party rights, title, merchantability, fitness for a particular purpose and freedom from computer virus, is given with respect to the contents available through the App or its links to other internet resources as may be available to Your through the App.

8.3 Reference in the App to any specific commercial products, processes, or services, or the use of any trade, firm or corporation name is for the information and convenience of the public, and does not constitute endorsement or recommendation by Us.

You can access the information we hold about you by writing to the Customer Services Team at the address given below. Please include as much information as possible to help us locate your records, including your full name, date of birth, email address and postal address, plus your Donor ID if you have it. It will also help us know if we are to look for recent records, or from how long ago. Please apply in writing rather than by email, so that we receive an original signature to compare against the records we hold.

We automatically track certain anonymous information about all our web site users based on what you do on the site. We use this information to analyse our users' demographics, interests, and behaviour on the site to understand and serve you better. We do not use this data to identify an individual. Without limiting other remedies, we may immediately issue a warning, temporarily suspend, indefinitely suspend or terminate your volunteer entry and refuse to provide our services to you:

(a) if you breach this Agreement or the documents it incorporates by reference;

(b) if we are unable to verify or authenticate any information you provide to us; or

(c) if we believe that your actions may cause legal liability for you, our users or us.
